1. Acceptance of Terms

Welcome to Vokably! These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Vokably ("we," "us," or "our") regarding your use of the Vokably mobile riddle game available at https://vokably.aham.ro.

By accessing or using Vokably, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the service.

2. Eligibility

You must be at least 16 years of age to use Vokably. This minimum age reflects the parental-authorisation threshold for consent-based processing under Article 8 GDPR and Article 5 of Romanian Law no. 190/2018; Vokably does not provide a verified parental-authorisation process for younger users. By using the service, you confirm that you are at least 16.

If you are under 18 years of age, you must have permission from a parent or legal guardian to use Vokably.

3. Service Description

Vokably is a free-to-play mobile riddle game where users solve word puzzles. The service includes:

Access to riddle puzzles created by us and other users
Ability to create and share your own riddles
Progress tracking and gameplay statistics
Social sharing features for completed riddles
Interstitial advertising when enabled
Optional marketplace and wallet/blockchain features when enabled; those features may involve third-party services, public blockchain records, and network fees

Service Availability: Vokably is currently available to users in Romania. We reserve the right to expand or restrict geographic availability at any time.

4. Account Registration

4.1 Creating an Account

To use account features, create an account through the Vokably app and our identity service at https://id.aham.ro/0f9s2.

4.2 Multiple Accounts

You may create and maintain multiple accounts. Each account is subject to these Terms.

4.3 Account Security

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use

4.4 Account Suspension or Termination

We reserve the right to suspend or terminate your account if we detect:

Suspicious activity that may compromise the security of our service
Violations of these Terms
Activity that harms other users or the service

You may delete your account at any time through the app settings.

5. User Content

5.1 Content You Create

Users can create and submit riddles through the account page within the Vokably app. By submitting content, you:

Retain ownership of your content
Grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content within the Vokably service
Represent that you have the right to share the content
Agree that your content does not violate any laws or third-party rights

5.2 Content Standards

All user-submitted riddles must:

Be appropriate for ages 16 and up
Not contain offensive, abusive, or inappropriate language
Not infringe on others' intellectual property rights
Not contain spam, advertisements, or malicious content

We reserve the right to remove any content that violates these standards without notice.

Users can share completed riddles by pressing "Share Story" after successfully completing a game (5 riddles). This feature allows you to share any riddle and its solution on social media or with friends.

6. Intellectual Property Rights

6.1 Our Content

The Vokably app, including its design, logo, code, and original riddle content, is owned by Vokably and is protected by copyright and other intellectual property laws.

6.2 Third-Party Resources

Vokably uses:

Google Play services and Firebase services for analytics, crash diagnostics, and push notifications
Google Mobile Ads when advertising is enabled
OpenStreetMap Foundation/Nominatim for reverse geocoding when a location-based marketplace feature is used
Third-party wallets and public blockchain networks when optional marketplace/blockchain features are used
Google Fonts and properly licensed sound effects

The processing of personal data by these services is described in our Privacy Policy.

6.3 Limited License to Use

We grant you a limited, non-exclusive, non-transferable license to use Vokably for personal, non-commercial purposes in accordance with these Terms.

You may NOT:

Copy, modify, or reverse engineer the app
Use the service for commercial purposes without permission
Remove or alter any copyright notices
Create derivative works based on Vokably

7. User Conduct

7.1 Acceptable Use

You agree to use Vokably in a respectful and lawful manner.

7.2 Prohibited Activities

You may NOT:

Use the service to harass, abuse, or harm others
Submit inappropriate, offensive, or illegal content
Attempt to gain unauthorized access to our systems
Use automated tools or bots to interact with the service
Interfere with the proper functioning of Vokably
Impersonate others or provide false information

7.3 Security Research

If you discover security vulnerabilities or technical issues, we encourage you to report them to us at vokably@aham.ro rather than exploit them. We appreciate responsible disclosure and will work to address reported issues.

8. Free Service

The core puzzle game is currently provided without a subscription charge. Advertisements may be shown. Optional marketplace or blockchain features, when enabled, may involve third-party or network fees; review any transaction details before confirming.

We may modify or discontinue features. If we introduce paid features or subscriptions, we will provide clear notice and updated terms where required by law.

9. Future Features

Some features, including advertisements, marketplace tools, wallets, and blockchain integrations, may be enabled, changed, or unavailable depending on the app version and service configuration. Optional blockchain transactions may be irreversible and publicly visible; we do not control third-party wallets or blockchain networks. Any additional feature-specific terms will be presented where applicable.

10. Disclaimers and Limitations of Liability

10.1 "As-Is" Service

Vokably is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

Continuous, uninterrupted, or error-free operation
Accuracy or reliability of content
Security of data or account information
Availability of the service at any particular time

10.2 Data Loss

We make reasonable efforts to maintain your data, but we do NOT guarantee against data loss. You acknowledge that:

The service is hosted on personal infrastructure
Technical issues, hardware failures, or other circumstances may result in data loss
We are not responsible for loss of game progress, user content, or account data

We strongly recommend not relying on Vokably as the sole storage for any important information.

10.3 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

Any indirect, incidental, special, or consequential damages
Loss of data, profits, or business opportunities
Service interruptions or unavailability
Any damages arising from your use of Vokably

Our total liability for any claims related to Vokably shall not exceed the amount you paid us in the 12 months prior to the claim (currently €0 for free service).

Nothing in these Terms excludes or limits liability or consumer rights that cannot be excluded or limited under applicable law, including liability for intentional misconduct or gross negligence where such limitation is prohibited.

11. Modifications to Service and Terms

11.1 Service Changes

We reserve the right to modify, suspend, or discontinue any part of Vokably at any time without notice.

11.2 Terms Updates

We may update these Terms from time to time and will update the "Last Updated" date. We will give notice of material changes through the app, website, or email where appropriate. Changes take effect on the stated date; where the law requires renewed agreement, we will ask for it. If you do not agree, stop using the affected service.

12. Termination

12.1 Your Rights

You may stop using Vokably and delete your account at any time.

12.2 Our Rights

We may terminate or suspend your access to Vokably immediately, without notice, for:

Violation of these Terms
Suspicious or fraudulent activity
Legal or regulatory requirements
Discontinuation of the service

12.3 Effect of Termination

Upon termination:

Your right to use Vokably ends immediately
Your account data may be deleted in accordance with our Privacy Policy
Provisions of these Terms that should survive (intellectual property, disclaimers, limitations) remain in effect

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of Romania and the European Union, without regard to conflict of law principles.

13.2 Jurisdiction

Any disputes arising from these Terms or your use of Vokably may be brought before the competent courts under Romanian law. This does not restrict any mandatory consumer rights, including any right to bring proceedings before the courts of the consumer's country of residence where applicable.

17. Acknowledgment

By using Vokably, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
